By using Modo News services, websites, or mobile applications, you are entering into a binding contract with us.
In order to use Modo News, you need to (1) be 12 or older and have your parent or guardian’s consent to these Terms, (2) have the power to enter a binding contract with Modo News and are not barred from doing so under any applicable laws. You also warrant that any registration information that you submit to Modo News is true, accurate and complete, and you agree to keep it that way at all times.
You agree to indemnify and hold Modo News, affiliates, officers and employees, harmless of and from any claim, demand, or damage, including reasonable attorneys' fees, asserted by any third party due to or arising out of your use of or conduct with regard to the service.
In no event will Modo News, its suppliers, resellers or its licensors be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, business interruption, loss of data arising out of the use, other intangible losses resulting from: (1) the use or the inability to use the service; (2) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service; (3) unauthorized access to or alteration of your transmissions or data; (4) statements or conduct of any third party on the service; or (5) any other matter relating to the service.
By using Modo News you expressly consent, agree and understand that use of the service is at your sole risk. This service is licensed and provided "as-is" and "as-available" basis. Modo News expressly disclaims all warranties of any kind, whether express or implied, including, and not limited to the implied warranties of merchantability, appropriateness for a particular purpose and non-infringement. Modo News gives no express warranties, guarantees or conditions. You bear the risk of using Modo News and makes no warranty that (1) the service will meet your requirements, (2) the service will be uninterrupted, timely, secure, or error-free, (3) the results obtained from the use of the service will be accurate or reliable, (4) the quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations, and (5) any errors in the service will be corrected.
Regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of Modo News or these Terms of Service must be filed within 30 days after such claim or cause of action arose or be forever barred.
To ensure service reliability for all users, acceptable usage limits will be applied. You may not use this service as means to run a third-party site. Modo News may terminate your access at any time, with or without cause, with or without notice, effective immediately.
You may have additional consumer rights under your local laws, which this license cannot change. Regardless of where you are accessing this site, you are responsible for compliance with all local and international laws. You agree that you will not use Modo News in any region or in any manner prohibited by any applicable laws, restrictions or regulations.
You agree not to access or upload illegal, unlawful, oppressive, harassing, libelous, abusive, threatening, harmful, vulgar, obscene, racist or otherwise objectionable documents or other material of any kind or nature. You agree not to archive or upload documents that infringe upon the intellectual property rights or other rights of third parties, including without limitation such rights under the law of patents, trademarks, copyrights and trade secrets; nor archiving any documents or other material which contain or include any malicious software intended to cause damage. To the extent permitted under your local laws, Modo News excludes the implied warranties of merchantability, fitness for a particular purpose and non-infringement.
Any amounts sent are purely donations and are not a part of any offer to purchase securities or any other interest. Donations are non-refundable after the time set by our payment processor expires, and you will own no equity, debt, or other interest (because that makes things really complicated). We are not a non-profit 501(c)(3) organization, contributions are not tax-deductible as charitable donations. However all funds received will be allocated in their entirety into service maintenance and development.
Modo News reserves the right, in its sole discretion, to change the Terms under which Modo News is offered. The most current version of the Terms of Service will supersede all previous versions. Modo News encourages you to periodically review the Terms of Service to stay informed of our updates. If you disagree with changes to the Terms of Service, then you should stop using the services. Upgrades to services will occur, and that these terms will apply to any upgrades. We will do our best to communicate the context behind these changes.
